Densification of the 4G network requires siting small wireless facilities (small cells) near population centers. This creates tension between the wireless industry, local governments, and residents. The FCC and Congress have moved to constrain local governments, and some of these actions were challenged in Federal courts. Knowing that local governments still control time, place, manner, and aesthetics - but cannot deny applications based on health concerns, resident groups opposed to wireless deployments shifted away from health and towards aesthetic impact and property devaluation messages. This session will provide an update on regulatory and legal actions related to small cells, an overview of how local governments are handling aesthetics, and a briefing on a seminal study that looked at the impact of small cell deployments on residential real estate valuation.
